A decision from the New York Court of Appeals on Tuesday said “no substantial constitutional question is directly involved” in his challenge to the gag order.

The gag order was imposed to protect the jury, court staff, witnesses and their families from being attacked by Trump during the trial.

Justices at the State of New York Court of Appeals wrote: “Appeal dismissed without costs, by the Court sua sponte, upon the ground that no substantial constitutional question is directly involved.”

Separately from this, the Manhattan District Attorney’s office is expected to respond at some point this week to Trump’s latest attempt to lift the gag order, post-conviction.
